Commissioners raise tax rate to $1.67

The Pickett County Commissioners met in regular session on August 15, 2011. Present and presiding was the Honorable Johnie Neal, Chairman and Robert Lee, Clerk of the Court. Court was called to order at 6:00 p.m. by Clerk Lee who turned the meeting over to Chairman Neal. The invocation was given by Johnie Neal. The Pledge of Allegiance to the Flag was given by all. All commissioners were present. The following proceedings were had and entered on the court minutes as submitted:
5. Passed a motion by Eddie Holt and seconded by Daniel Masiongale to approve the agenda as amended. All aye. Motion carried.
6. Carried a motion by Colan Huddleston and seconded by Darrell Garrett to approve the minutes of the July 18, 2011 regular county court meeting. All ayes. Motion carried.
7. Approved a motion by Eddie Holt and seconded by Kenny Tompkins to approve the minutes of the July 28, 2011 special called Budget Committee meeting. All ayes. Motion carried.
8. Passed a motion by Lana Rossi and seconded by Darrell Garrett to approve the minutes of the July 29, 2011 special called county court meeting. All ayes. Motion carried.
9. Carried a motion by Eddie Holt and seconded by to conduct county court meetings, effectively immediately. All present voted aye, except Tony Beaty, Joe Harden and Terry Manis who voted nay. Motion carried.
10. Approved a motion by Tony Beaty and seconded by Colan Huddleston to approve Resolution #11/12-1. This is a resolution resolving that the Pickett County School Federal Projects Fund for the No Child Left Behind Act (NCLB), Individuals with Disabilities Education Act (IDEA) and the Carl Perkins vocational projects shall be the budget approved for the separate projects within the fund by the Pickett County Board of Education. All ayes. Motion carried.
Prior to item 11 there was a 5 minute recess.
11. Motion by Lowell Winningham and seconded by Lana Rossi to approve the Proposed Tax Levy Resolution for Budget Year ending June 30, 2012 at $1.67 tax rate. All ayes, except Tony Beaty, Joe Harden, Colan Huddleston, Doug Manis, Terry Manis, Daniel Masiongale and Lowell Winningham. With a vote of 5 ayes and 7 nays. Motion failed.
B. Motion by Colan Huddleston and seconded by Tony Beaty to table any action on item 11 until more information is presented. All ayes, except for Eddie Holt, Doug Manis, Daniel Masiongale, Becky Matheny, Lana Rossi, Kenny Tompkins and Lowell Winningham who voted nay. Motion failed.
C. Motion by Joe Harden and seconded by Lana Rossi to rescind a motion on item 11A and change Tax Rate from $1.42 to $1.67 for FY ending June 30, 2012. At that time Tax Rate is to be changed back to $1.42 for FY ending June 30, 2013. All voted nay except Darrell Garrett, Joe Harden and Lana Rossi who voted aye. With a vote of 3 ayes and 9 nays. Motion failed.
D. Passed a motion by Darrell Garrett and seconded by Lowell Winningham to rescind a motion on item 11A and change Tax Rate from $1.42 to $1.67 for FY ending June 30, 2012, thus exploring every avenue to generate funds to lower tax rate for FY ending June 30, 2013. All voted aye except Tony Beaty, Colan Huddleston, Doug Manis, Terry Manis and Daniel Masiongale. With a vote of 7 ayes and 5 nays. Motion carried.
12. Carried a motion by Becky Matheny and seconded by Kenny Tompkins to amend item #12, to include UT Extension office with proceeds in the amount of $2500.00. All ayes except Lowell Winningham who passed. Motion carried.
12A.Approved a motion by Eddie Holt and seconded by Daniel Masiongale to approve the Proposed Non-Profit Organization Appropriation Resolution for budget year ending June 30, 2012 as amended. All aye. Motion carried.
13. Passed a motion by Lana Rossi and seconded by Kenny Tompkins to approve Proposed budget and Proposed Tax Rate for FY ending June 20, 2012, as amended. All voted aye, except for Tony Beaty, Colan Huddleston, Doug Manis, Terry Manis, Daniel Masiongale and Lowell Winningham who voted nay. With a vote of 6 ayes and 6 nays, Chairman Neal broke the tie vote with an aye. Motion carried.

•Carried a motion by Tony Beaty ad seconded by Colan Huddleston to allow the Pickett County Landfill to retain all proceeds from cardboard sales. All ayes. Motion carried.
15. Passed a motion by Colan Huddleston and seconded by Becky Matheny to adjourn until the next scheduled county court meeting on September 19, 2011 at 6:00 p.m. in the Community Room of the Pickett County Library without roll call.
